THE LAW
Throughout the exposition of the events, we can clearly understand that the media exposure carried out, puts into question several fundamental rights:
Honor when Fernando García blames live certain figures, basing himself on speculation, not presenting concrete evidence.
Intimacy when the moment when the families know that the bodies belong to the three girls, and their pain, their mourning is transmitted on television.
Image itself when there is the capture and broadcasting of explicit images of the girls, when Desireé's mother, Rosa Folch, does not authorise the use of her daughter's name or images for profit. Finally, when in April 1998, the General Secretariat for Social Affairs agrees with Rosa: the foundation, which Fernando wanted to create, could not be registered under the name "Niñas de Alcácer" without the consent of Rosa Folch, as to do otherwise would be a "violation of the rights to honour, privacy and her own image".
Data protection of minors when the lives of these girls are exposed, when Esther's life is exposed, when she is constantly interviewed.
Freedom of information and expression no longer takes into account the limits of privacy and overrides this right.
